employment-based immigrant visas and imposing fees for
immigration services for intracompany transferees. I apologize for
the delay in my reply, but I appreciate hearing from you and I
welcome the opportunity to respond.
I agree that the U.S. government should recapture unused
employment-based immigrant visas and impose immigration service
fees for those visas. As you may know, the United States Senate
version of the Deficit Reduction Act of 2005, S. 1932, included a
provision that would recapture up to 30,000 H-1B visas that had not
been issued in prior years. Also, S. 1932 would impose an additional
$500 fee to obtain these recaptured visas. These provisions were not
included in the House-passed version of the Deficit Reduction Act of
2005, H.R. 4241. Unfortunately, the Conference Committee, which
was responsible for resolving the differences between the House and
Senate versions of the bill, did not include this provision in the
final
version of S. 1932. The final version of S. 1932 passed in the House
by a vote of 216-214 on February 1, 2006. President Bush signed this
bill into law on February 8, 2006.
Please be assured that I will keep our shared support for
recapturing unused employment-based visas and imposing fees for
immigration services for these visas very much in mind as Congress
considers immigration issues.

My main worry is that since I dont have a copy of the I-140 approval from old employer, Is there a way the new employer can ask USCIS to look up that case(I have a copy of the receipt)?

My termination date is Sept 15th.

I am currently in the same situation like you are (and hopefully were?); they are a mistake in filling the ETA9089.
The error is in such a way that from USCIS point of view, I worked during the gap of period between my OPT and H1-B transition.
So I guess I just want to know how your case is resolved? That way I have an idea what will happen to mine. ;(

Can the attorney file an I140 for a candidate while the candidate is out of USA? Or does the candidate have to be physically present for the I140 to be filed. In addition does the candidate need to be here for the entire processing time for I140 or can he go on vacation ?

I am currently using EAD. My I-485 is pending status. I am planning to get married in India soon. She will be in India as I can not bring her on H4 and student visa is difficult. So dilemma is about 485 name addition. Can I add spouse's name in I-485 application whenever Priority Date is current?
If yes, then how does it work? I mean is it possible at all?
It is going to be difficult. She has to come in on some kind of dual-intent visa. She could come in on a student visa but would be difficult to prove that she does not intend to immigrate in the interview if they find out about your I-485. Alternatively, you would have to get a H1 and she would have to come in on a H4.

I filled the DS160 and took an appointment at US consulate yesterday night with out the photograph. Looks like we can submit the photograph along with the confirmation letter on the day of interview.
I thought we needed to upload the photograph for completing DS160 but that does not seem to be the case. Did any of you experience this?

I want to transfer my H1 , I got aproject . But I dont have Jan Pay stub . I have up to Dec 2008. will it cause any problem for transferuess
I guess your question has been answered many times.. If you do manage to get the H1 filed there will definitely be an RFE. Instead please try to speak to your employer and get the pay for the time you were off the project as he is legally supposed to pay your salary even if you were off project. You can always request payroll's run for backdated wages. If you are not able to convince your employer to pay you file a complaint against them at DOL and then apply for H1 transfer with supporting information so that the USCIS gets to know that it is not due to a fault of yours that you are unable to produce the pay stubs

You need approved EAD. apart from waiting for 180 days. You also need I-140 APPROVED. If you have just recently applied for EAD (2 weeks ago) Do not expect it till atleast early April. It is taking them more than 90 days to approve EAD.
WAIT till you get EAD Approved AND I-140 Approved. Research about AC21 and how you can take advantage of that. Read up threads on AC21. It is going to be a longer wait than you thought.

Hello,
I am on h1b visa (approved & stamped) and its expiring this Oct'10 (I-94 also expiring in Oct) and due for an extension but here's my problem.
Company A filed my petition in a wrong way in 2007 by showing the job title as "mechanical engineering position" though i was working as Analyst in IT. So if company A files my extension now how likely are my chances of getting my extension approved? as there was no amendment submitted by A for a change in my job title. The below are my options so would really appreciate if you all can suggest and share your thoughts?
1. Go for a H1B extension from Company A itself and if RFE/Denied, can i then proceed with a H1B transfer from Company B? Confused here in figuring out that if my extension is denied will i loose my status and am i eligible to file a new petition as a transfer from Company B?
2. Or directly go for a H1B transfer from a new Company B, this way will i have lesser risk in getting rejected?

Hi Old Monk and GC.....Thank you for your reply. I am canadian citizen by naturalization. Is it a fast process for naturalization (not by birth) Canadian Citizen too? I havn't applied for I-765. As right now, my husband has no intention me to work in USA. Suppose in future if I decide to work...Can I work once my GC will approve, or do I have to have file I-765 to get permission to work?
Its been only one week, since I have mailed my I-485 to Chicago office. I havn't got my reciept yet. So,will wait for another week or so. I have been looking topics like this one. Does anybody know if H-1 H-4 can apply for financial aid? does it come up during GC process as goverment aid and therefore could put you GC approval in danger of being rejected? I read somewhere a list of federal help we can use and be OK. Does someone know where to find info?. I have a daighter H-4 who starts college this year. She qualifies for in state tuiton. Does this affect her GC process? You never know when issues like this will surface along your process. I don't want to make any mistakes. Is someone in similar situation?

I think they carry only their own documents + hdfc receipt etc stuff in original.
All other documents (that are not issued to them) are a copy e.g. your I797 notice, copy of your passport, visa etc.
Your Birth certificate is one such document hence copy should be fine. And also your passport also has a name of each parent.

If you look at Murthy.com and search for articles on AC21, you'll find information on the two types of codes the DOL uses. The go to the DOL website and do a search for the two types of occupational codes and see which classification system your code matches. Once you access the classification, just look for your number and it should give you a brief description. I did this for my code.
