2. But for the other applicants who are struck in BEC from 2003/2004, we are with you and we will work with IV to address EB related GC issues. I know BEC set Sept 30, 2007 as final date to process pending labor applications and many cases are approved.
So wait and fight for few more months and then file I-140/485 concurrently. IV will keep these people in their mind and will work hard during CIR or strive bill discussion so that no restrictions are put on your application while filing I-140/485. our prayers are with you.
Since the dates are going to retrogress in next few months or so, we need to request USCIS & lawmakers to allow filing I-485 even if visa numbers are not current, exempt spouse & dependents from quota, remove hard country limit, and so on....

Cheers to everyone who decided not to ask IV to reimburse the fee difference that they paid to Airline companies.

I was one of the members who bought the ticket early for Sep 13 and had to rebook. Initially, I did ask IV to reimburse me but after receiving a very nice email from Aman and seeing how sincerely they wanted to set things right (regardless of whether I could make it on Sep 18), I never took them up on the reimbursement offer.
Attending the rally was great! The people who did not come have missed out on a unique experience.

I have submitted all the documents to my laywer on 6/25 itself (including medical) but they are just heavily back logged and won't be filing my case till Jul 10. I am just frustated now. I even offered to pay extra to speed it up but no use. I am only worried if dates retrogress half way through?
To my real question.. Can we just file on our own with out the lawyer? I would hate to loose this window just coz my laywer couldn't do it. Hi! You are not the only one, many people like us are in the same situation as yours. However, there is nothing you can do if the dates retrogress.
Lot of people are filing 485 on their own and you can do that too, I guess. There is a seperate thread for this, please refer to that thread.

I beg to differ from your point of view that approvals are on PD. If you take a good look at the PDs of approved cases posted here, you will there are many post July 04 (mostly in Oct and Dec 04) and we all know there are many before that.
They are clearly going by ND. I have seen 1/2 case approved that had ND after 8/30/07
They dont prioritize inside the current time window. In otherwords, they dont necessarily go Jan, Feb, Mar etc. They just do it if its inside Jan 2005.

We reached the gurudwara at 4:30 AM only to find that the building said "Catholic Church". Since it was a pretty large compound we thought that the gurudwara might be one of the buildings in the compound or shared by the Catholic Church. So we waited for the gurudwara manager to arrive.
After about 20 mins, I got a call from the manager asking us where we were. I told him that we were at the parking lot. He sounded surprised and that's when I realized that there was something wrong. I asked him for the address and it turned out to be 3801 instead of 3810 (where we had parked). Lucky for us it was just across the street!
The manager was very helpful. He even prepared tea and got us donuts while we freshened up! Not just that; he woke up at 4:30 AM and drove to DC from Virginia to open the gurudwara for us!

I talked to a staff member at senator Barbara's office, and the staff member said, Faxes and emails are responded and replied by staff reps. Only written (typed) letters go to Senator's attention. She also advised me that if this is something you need the senators attention on, do not send fax or email, send a letter with postage paid.
I explained to her the visa -flip flop, and she said most likely the senator will read and send an inquiry, The senator is very good at responding to letters from constituents.
That is exactly why we need to send them letters, please look at the format and add some personal details, gives it a little personal touch.

Hi! is this true? they are approving cases randomly? what happen to FIFO?
I guess one has to pray for luck ! Is there no reason to worry? What if your case has been denied after 13 months of waiting , that's really bad luck.

i asked the same question about rejection they said we dont accept any rejections and we will file MTR, and they dont have any rejections from past 6 years
one of my friend in the same company got approval in 3 months that one is not audited
we both filed at the same time atlanta centre he is lucky guy

1. What was mentioned in the job advertisements - was the alternate Bachelors+2 years mentioned
2. How long as it been since the last advertisement
3. Can they file another I-140 concurrently with I-485 using the recently approved labor
4. I agree with abhijitp you can get a RFE too
My suggestion would be to apply in EB3 even though the job advertisement reads masters or Bachelors with 2 years and use the option 3
I request you guys to consult a good attorney immediately and help your selves and also save time.
