this is a little bit off topic, but does anyway know what are the requirements for practicing immigration law in the US? What kind of formal training and bar exam passing etc are needed?
With the extensive practice that USCIS has provided us, atleast in EB matters I think for most of us it will be a cakewalk. Having gone through the process ourselves we also understand how to treat the immigrant (frequent updates, clear answers, be accessible, provide all options and information) and some of us could make very good immi lawyers (once we get our EADs).

Hi All,
I have recently applied for my wife's EAD to Phoneix Lock box and got the Receipt from NSC with the LIN number. RD: 02/25/11 and ND:02/28/11. Check also got cashed. I tried to access that receipt number in USCIS case status website online to get the status yesterday 03/09/11; it says the case number is not found. I am sure I typed the correct receipt number. Any idea what could be wrong? Has anyone experienced this before? Should I contact the customer service? Please help me.

Hi,
There is wrong priority date on my Labor Certification approval. They
put 2001 instead of 2002 .
It looks they apparently mixed date with some other candidate who have
similar name as mine. They lost his case and put his priority date on mine.
Now can somebody tell me what are my options?
I can not file if the priority date is correct on LCA. But If I apply
for 1-485 using this wrong date, it may be risky because if they find
the correct date it may be problem.
Therefore, I don;t want to take any risk, I just want to apply for
I-140 but should I contact LABOR OFFICE to fix the date and then submit
the application for I-140. Unfortunately Labor Office is not replied
yet on my request to fix this issue.
Any Advice.

Hello
My wife went for H4 interview on 1/11 and she was asked 3-4 basic questions and her passport and original I-539 was taken. There was no other communication give to her and/or any colored slip given to her.
She has AP and 485 filed but AP didn't come through and she has receipt for both, but VO at delhi didn't look at them.
Its been over 6 business days and no information of passport yet.
We called up consulate and they say its still in processing.
I have read in prior forums with "PIMS", is this delay because of it?
Did someone else had similar experience at Delhi and how long did it took for the passport to arrive.
Sort of quite worried seeing others post that its taking 4-5 weeks for some, but H4 it really shouldn't be that much....

I am working in US on L1A visa expiring in November 2010 (completing 7 years). The Visa with whom I am working are not processing my GC. Before changing my Visa to L1A, I had H1B which is expired now. So I am applying for PERM through another employer. This employer/attorney is going to file for Labor in one or two months. What are the chances of my Labor and I-140 getting approved before December 2010? If my Labor got approved by December 2010, Can I switch to the employer who has applied for PERM and continue staying in US? Are there any options? Please advice. Thanks for your time.
PERM processing for non-audited cases is taking anywhere from 8-12 months these days. Assuming your case does not come under audit, then yes, with premium processing of I-140, you can expect both your Labor/I-140 being approved by Dec 2010 (assuming the 8-12 month PERM processing times still hold good)

2)Can we do part time Phd on university H1 working with university?
3)Is there any extension after 6 yrs for university H1?
4)Can one apply for Greencard on this University H1?
5) If we have to change from University H1 to Industry H1,is that also through normal regular H1 cap lottery method of selection?

both my wife and myself got EAD's in Oct 07, my question is does she has to invoke AC21 to get on to EAD.
I am the primary candidate for our GC Process.

Well, my forms were returned to my attorney because of some filing issue. So instead of my EAD as I was expecting I have to refile. Of course I now have a job offer that I would like to take.
My husband (who is a US citizen) is in school and will be depending on my salary. I dont know if that counts as a big financial loss.
Where can I go to find this out. I think my attorney i doing a less than great job in giving me the proper options to choose from.
Any help would be appreciated.

I would appreciate if someone could answer the following question. Before I ask my question, below is a brief background:
- H-1b Date Started: October 2005
- Current H-1b expiration: August 2010 (when I switched my last job in August 2007, they extended for 3 years)
- Date of filing labor: January 10, 2010
- Time outside US on H-1b: about 90 days.
My attorney at work said that I would still need approximately another two months (comfortably) of time outside of the US that they can recapture. This extension would take me into late January 2011, more than one year past the point of the PERM filing. They can, at that point, apply for a 'seventh year' H-1B extension based on my PERM process having been pending for more than one year.
Here is my question. Since I am currently in my fifth year of my h-1b, would it be possible now to apply for the sixth year of h-1b visa until October 2011 instead of looking at seventh year? I started my h-1b in October 2005. Therefore, I have until six years before my h-1b visa can expire, is that correct? If this is not correct, I would appreciate if anyone has any other suggestions to avoid travelling for 2 months out of US prior to July 2010.

Rep. Steve King (R-Iowa) isn�t wasting any time with his immigration agenda, dropping a bill on the first day of Congress that goes after birthright citizenship.
King�s measure would amend the Immigration and Nationality Act, ending automatic citizenship for anyone born in the country. Instead, the measure requires that only the children of citizens, legal immigrants permanently living in the country or immigrants in the military, be granted citizenship.
Republicans grabbed headlines last summer after Sen. Lindsey Graham (R-S.C.) criticized the longstanding law, saying it encourages pregnant women to come to the country to have children so they can eventually become citizens themselves.
Though others have called for changing the 14th Amendment, King said that ending birthright citizenship through statute makes sense because it�s easier to do.
�We need to address anchor babies,� he told POLITICO Wednesday. �This isn�t what our founding fathers intended.�
Immigration legislation isn�t high on the list of priorities for House GOP leaders.

The Memo was offering administrative relief options to promote family unity, foster economic growth, achieve significant process improvements, and reduce the threat of removal for certain individuals present in the United States without authorization.
