Hi guys,
Some of may think "Wait for the actual letter to come" but I feel too nervous and just want to share my thoughts. I applied for EB5 and my I526 was approved. Then I applied adjustment of status and got an I485 RFE. Have not got the letter yet but got the email that my case is on hold right now. Can you tell me about the RFE? Is that common? Is that the first step of denial? I'm so nervous right now. I will write what they are asking when I got the letter which I'm expecting on Tuesday or Wednesday. Thank you very much.

Thats a very good question.Off late I am seeing lot of people moving back.I can quote my friend's brother.He lived in this country for the last nearly 18 years.He has 37 patents to his credit.He started his company in 2000 and sold that company to Motorola and currently he is a venture capitalist to Bio-tech start up.I was talking to him other day and hes going back for Good in July.
He was of the opinion that you have to always ride the wave.The gold rush of 2000 and before is gone here.It was his opinion.
I think the main reason is people have slogged here and they want to take atleast some benefit of GC.We are contributing Social Security and you will not see a single penny what you paid to Uncle Sam unless you have a GC.

Once you give out your EAD for employment your H1 status goes in limbo. I think the way to go back on H1b status is to exit the country and reenter with H1 visa and then work only for the employer who sponsored the H1b (in case something terrible happens to your AOS).
But again this is just my analysis; and I am not a lawyer.

People who are in US just for conversion rate can now think of this move. I USD = 39.4 INR, 1 Canadian $ = 37.xx. Not a big difference.

I jst got an update on my and my wife I-485; i am not sure what it is about as i have not received the RFE yet.....but i think they are asking for our BC as we did not provide them when we applied for I-485;
I want to know that is it OK if i provide USCIS with the 2 AFFIDEVITS, one for me and one for my wife stating all the information such as Name, Date of Birth, City of Birth, Country of Birth, Mothers Name and Fathers Name.
Gettign the birth certificate is a very long procedure and i dont think i would have them soon. So i was wondering will it be OK if i provide them with the Affidevits. Will USCIS accept it!!!!
Lastly, i would appreciate if some one can give me the template that what text should be included in the affedevit !!!!

Here is one last scenario ( perhaps that is why all attorneys are saying - 'continue with your filings and go on with your life' AND all old saws all good old folks at IV might say 'I told you so'). So, not to be let out, here is my take on things to unfold tomorrow:
Why did they wait till Jul 2?
They will release the Aug VB tomorrow. In which they will retrogress most or all categories to 'U'.
They will enforce the 'DMV office rule'. All who have filed on the basis of Jul VB, will be receipted, may be finger printed but AOS adjudicated and GCs issued as dates become current.
Good night and good luck to all, particularly to those '599 (174 members and 425 guests)'

I am currently on H1B, and my current company is not willing to sponsor me for GC. I am in my 5th year. I have found another company who has agreed to hire me and start my gc process, however, I am in a fix. This new offer is in CA and I am currently in NJ (+ my family)
I don't want to take this option unless it is absolutely necessary. My spouse, has the I-140 approved and not yet filed I-485. PD is Jan 04, EB3.
What are my options?
How many months left for you in fifth year? You need atleast 6 months to join another company so that they can do all the necessary steps in those 6 mnths before they file PERM. Are you trying to transfer to consultancy or full time employer?

I know that UK and France require transit visa, but I was wondering whether I can fly via KLM (Amsterdam) OR Lufthansa (Frankfurt) without any transit visa ?

I can say with certainity that transit visa is not required for return through Amsterdam on AP. This year 2010, was my second travel through Amsterdam with AP and the port officials really respected the document and treated me very well.

My employer has been playing this game with me. He filed for my Labour and it got approved in August of 2007. However he did not file for my I-140 until Feb of 2008 , just a week before the labour would expire. Now its been over year , he does not give me my SRC number but keeps telling me its been approved under EB-2 catagory. As for me , I am current in EB-2 , I just checked April Bulletin and I still am current. It looks like he is not going to file for my 485. Is there anyway I can make him file or file myself. Please know, the lawyer is on his side as well. I have asked the lawyer number of times for SRC number but he does not provide that either. What are my option other than joining a new company.

As stated above, interim EAD is not anymore issued at local center. What you can do after 90 days has lapsed, schedule an infopass appointment and then ask to expedite your EAD. In most cases, it doesn't exceed 90 days. A few unlucky one's had it in about 110 days!

This pieces and other recent pieces show that plodding ideas about commissions and study groups to recommend visa numbers are relics of a past age. The question is, will Congress act quickly enough on immigration reform to actually make a difference in helping our economy recover. Every immigration lawyer knows these simple truths--lazy people do not walk across the desert. And, its corollary--the Hope that is American attracts those willing to work hard to succeed. Well, the former principle is still true, at least for now. The latter is giving way to hopelessness--backlogged visa numbers ("encased in amber"), and a growing and vibrant economy in China and India. The failure to act quickly is going to cost America in the long run. My attorney signed my I-485 AOS/EAD/AP applications and posted them on July 2nd as he was in a hurry to apply because of July 2nd scenario. Is it ok for the attorney to sign our papers. Is anybody in the same boat as me. I am a little concerned as the USCIS FAQ says application can be rejected if signature is missing. The application reached USCIS on July 3rd.
My attorney also did the same. I did not sign on my application. But he sent me power of attorney to sign. They did this since they were beating the July 2 brouhaha which previous to that week, they already knew what's going to happen.

If I-140 is approved and priority date is current is it possible to keep on extending H1B for couple of years without applying for I-485? I am asking this quetion because my employer is not allowing me to apply for I-485 as my I-140 is pending. It looks like he want to use me for couple of years on H1b.
