If I-140 is approved and priority date is current is it possible to keep on extending H1B for couple of years without applying for I-485? I am asking this quetion because my employer is not allowing me to apply for I-485 as my I-140 is pending. It looks like he want to use me for couple of years on H1b.
You can apply for I-485, Even if I-140 is pending. Talk to your employer and use this opporturnity to get I-485 filed asap.

First thing is never give USCIS more than they have asked for.
Send them a letter stating that your previous attorney made a mistake and you have never applied GC before.
secondly since incomplete medicals are bound to have another RFE, there is no harm in sending them revised medicals and yes they have to be sealed from USCIS approved doctors.

Hi
We have applied for I -485 last month.I am the primary applicant and my spouse is add on.Bothe of us are on H1B and it is valid till end of 2008.
I have applied for EAD and advance parole for my spouse only.We have not yet received the receipt numbers .I was wondering if we want to travel outside the country do we need to wait untill we get any of the above or if we have a valid H1B can we travel outside the country.
Thank you very much for your help.
If you'll have a valid visa stamped on your passport then you guys have no issue on traveling outside U.S. Please do carry your 485 receipt notice while traveling.
If you do not have a valid visa stamped then you should wait till get your AP and then travel on AP.

I guess your H4 is not approved yet and continuing your employment on H1B. Your best course of action would be to have your employer file an extension (beyond 6 years) for H1B and get a 3-year approval (with approved I-140). You can change jobs after this but if you don't want to take this path you can still find a new employer before end of march and apply for H1B to get a 3-Year H1B. You will need to restart your PERM and go through the whole process with your new employer ASAP.

Only one good thing I can see on PBEC efficieny is atleast they are processing cases from Nov 04. Which is really really a good news based on the pace they were at last year same time.
Its not a surprise to anyone who is member of this forum that how efficient PEBC works!! As a matter of fact I have an excellent example here with my Labor Certification, which I wanted to share with you all.
My company just received a latter titled as "Confirmation of Withdrawal" which states that your Labor Processing Application filed in November xx, 2004 is withdrawn, as requested by your letter dated August xx, 2004.
Isn't that amazing that they are so swamped and desperate in eliminating the backlog that they do not know the chronological order of the dates also?
Backlog Elimination Centers' are the biggest waste of Taxpayers Money, I think.

Does any one remember if at the time of finger printing for 485, did they enter the Receipt Number, A# or both in their computer.

from what we see on other posts, what matters most is
1. company is hiring u as a fulltime employee
2. job desc is same or similar
3. annual salary is >= one specified in approved labor
you can get paid by hr, but just extrapolate that hrly value into annual salary, and state that.

Please help me in this regard.
I came to US in Sep 2003 using H4 visa. Later in 2004 I applied for H1 visa with two different companies. first one got approved in Oct 2004, second one got approved in Nov 2004. I started working with the second company since Dec 2004.
Now, is it wrong not joining the first company upon approval. Since H1 status starts as soon as visa is approved, have i violated any status rules here by not working with first company at all?. What would be my status since the first H1 was approved and until i started working with second company?
Had i been out of status during the time period between Oct and Nov 2004?

the meaning of backlog is to indicate that there AREN'T enough visas available to make a category current. being current means there ARE enough visas available for your category.
so in essence, someone who is current isnt considered back-logged or vice-versa.
