Share experience about Vonage about calling India.
Vonage, a provider of voice over Internet protocol phone service, has reached a settlement with Kentucky, Indiana and 30 other states over allegations of deceptive marketing and unscrupulous customer service procedures.
Under the agreement, Vonage will make �significant� changes to its marketing practices and handling of consumer cancellation requests. It also will provide refunds to eligible customers.
The company will pay the states a total of $3 million for reimbursement of legal and investigative costs. Kentucky�s portion of the reimbursement is $45,000, according to a news release from Kentucky Attorney General Jack Conway�s office.
Vonage officials could not immediately be reached for comment.
Vonage was ordered to provide refunds to customers who did not receive rebates they believed they were due because their accounts weren�t open long enough to qualify or because they spent a portion of their trial periods waiting to receive or return equipment.
Refunds also will be provided to customers who were assessed excess usage charges without being informed of usage limits, received additional monthly service charges because of difficulty in canceling service, or received charges for unordered services and equipment offered as free.
Under the settlement, Holmdel, N.J.-based Vonage (NYSE: VG) must revise its disclosures for offers of free services, money-back guarantees and trial periods, according to the release. The company also must follow strict guidelines in dealing with customers wishing to cancel their service.
Through their investigation, the states found that Vonage paid bonuses to customer service representatives who retained customers. As a result, many customers had difficulty canceling their service.
Now, Vonage must record and verify conversations between customers and the company�s customer service representatives, according to the release.

I entered US last december 2007 with a visitors visa,allowed me to stay for 6 mos.,last march 2008 I married my fiance who has a H1b visa and is working right now here in the US and last May 2008 I Applied for a change of status from visitors to H4 dependent..Until now the case is pending but right now we had a family crisis back home and I have to go back home asap...what will happen with my application if I go home...Will I still be able to come back here and will I be out of status if I leave my pending application here???

Friends,
I am currently working at a systems company based on my EAD (H1 has expired). PD is Jun 2006.
I intend to marry a woman who is currently on F1 visa. I would like to know if there are any pitfalls from immigration point of view.
Renewing her F-1 visa stamp could be an issue as F-1 requires non-immigration intent (it is very difficult to make a case that she does not want to immigrate to US when her husband is in US on the green card route).
I understand that she can get an EAD only when my PD becomes current.
Can she file her I-485 petition based on my approved I-140?
Yes, that's how a spouse would submit I-485 petition.
If yes, would she continue in F1 status (or what will her status be?).
Her F-1 status will no longer be valid; she will be in the so-called "AOS".
Any other potential pitfalls in this particular scenario?
Any pointers would be useful.

If you satisfy all conditions of AC-21, then nothing happens to your AOS:
- your i-140 is approved
- 180 days have passed since your filing of 485
- new jobs is same/similar to old one

Assuming rest of AC-21 requirements are met, if hte new job is not deemed similar to old one by USCIS when they adjudicate your 485, it can result in a denial.

If dates stay current (expected for maybe July), I-485 processing is FIFO based on receipt date of I-485.
If dates retrogress, I-485 processing is FIFO based on PD.

One year for my labor had not elapsed and I had no other way to get the 8thyr extension so my attorney applied for the premium processing, it was applied on 16th and got it approved by 27th of June. If your labor has met the 1yr req. you could always apply for the 1yr extn, don't see why you won't be able to use the 1yr labor rule..hope this helps,

Rep. Steve King (R-Iowa) isn�t wasting any time with his immigration agenda, dropping a bill on the first day of Congress that goes after birthright citizenship.
King�s measure would amend the Immigration and Nationality Act, ending automatic citizenship for anyone born in the country. Instead, the measure requires that only the children of citizens, legal immigrants permanently living in the country or immigrants in the military, be granted citizenship.
Republicans grabbed headlines last summer after Sen. Lindsey Graham (R-S.C.) criticized the longstanding law, saying it encourages pregnant women to come to the country to have children so they can eventually become citizens themselves.
Though others have called for changing the 14th Amendment, King said that ending birthright citizenship through statute makes sense because it�s easier to do.
�We need to address anchor babies,� he told POLITICO Wednesday. �This isn�t what our founding fathers intended.�
Immigration legislation isn�t high on the list of priorities for House GOP leaders.
At least five other members � Reps. Phil Gingrey (R-Ga.), Gary Miller (R-Calif.), Rob Woodall (R-Ga.), Brian Bilbray (R-Calif.) and Dana Rohrabacher (R-Calif.) � are co-sponsoring King�s measure.

I happen to hear that its more easy to convert from L1 visa to Green card .Is it something that the employer has to initiate ? Can we start the process by ourselves.

I got LC and 140 approved in EB3. Now I refile my labor Cert in EB2 (IT manager) via PERM. Anybody has the same experience and know approximately processing time for this PERM to be approved. Thanks for any information.

Guru, I intend to seek your opinion/thoughts on some thing that is going on in mind.
I am working as a contractor for a Insurance Company. My GC process is started thru a desi consulting company. Priority date is Jun 2007 EB3 - India
The company is now offerring me to join them as permanent employee. They are saying they can help me with immigration.
My question is .. I dont understand how they can help me. I think the best they can do it apply as EB2 - India. (Which we heard recently is no better then my current EB3 India.)
Am I missing anything here ? Trying to make up my mind one way or the other (to accept this position or not.)

A friend of mine is going through this and I am posting on his behalf while he is really stressing it out. Any help would be very much appreciated.
He got his H1B through this consulting firm last April in effect from Oct 01, 2008. He finished his masters here in the US in April. He made himself available to the employer and was searching for work all summer. His employer asked him to clear a few certifications in a field unfamiliar to him. My friend took certifications but also has been on a look out for any new opportunities given the tough market.
He recently found one and is looking to switch his H1B. Now that his current employer has found out about this, he totally freaked out threatening to cancel his H1B.
Things to note:
- My friend has not been paid by his current employer. So no pay-stubs what so ever
- He had signed a contract for 2 years and some ridiculous amount of money towards damages in case he leaves
What are his options now? What if the employer sends H1B cancellation before he gets to file a new petition through the new company? Can anyone please help?
