My PERM was filed and I got the following email from my lawyers
" Labor Certification by ABC ABC, Inc. on your behalf has been submitted via the Department of Labor�s (DOL) Permanent Online System as of the above date (April 1) . The application will be adjudicated by a National PERM Processing Center. As the DOL does not currently have a processing schedule for PERM applications, we are unable to predict how long processing will take. In the past, PERM applications have been adjudicated anywhere from a few weeks to several months. Unfortunately, there is currently no way for beneficiaries to check the status of the application. We will contact you as soon as we hear anything specific regarding your case. "
1. Is there any place where you can check the status ? Since I do not have any reference number, and from the text of the email, I doubt that.
2. I checked some forums and found that the average processing time is 60 days. Which processing center should I be looking for ? (I work at Oracle in SFO)

I just want to start a thread for folks whose primary applicant is approved but derivative is pending. My case was approved on July 8th, but my wife's case is still pending. Here is the complete list of steps that we have taken.
1) Created an SR on 07/09/2010 (No response yet)
2) InfoPass appointment on (07/16/2010); Reveals that case is pre-adjudicated.
3) Submitted form DHS-7001 (07/19/2010)
Please share your comments, thoughts and experiences on how you dealt with this situation.

Hello,
I'm outside US with AP (expiring in about a month). My GC has been approved this June.
My GC employer has run out of work. He is likely to get work later.
My options are:
a) Stay outside US and look for project. On getting confirmed work, enter US to join employer.
b) Enter US, look for project. On getting confirmed work, join employer.
Getting employed by GC sponsor employer with, either option could take few months.
While entering US, I will NOT have EVL(employment letter), only AP & I485 Approval Notice.
Which is safer option (a or b) for US entry ?
What questions can be asked at POE ? What should I say if asked about employer ?
Can GC be revoked at POE?
Which is safer option (a or b) for GC renewal, citizenship ?

Convert H1 into Premium. You need to get the results before Sept-20. So that you can apply for F2 visa.
Preferably yes, you should apply before the I-94 expires.
However, I am not sure if a new H1B or F2 application MUST be filed before the I-94 expiry date. If the I-94 is expired, it won't be an "extension of H1B status" or "change of status to F-2" but it will be a new visa. So, she can still get an approval, then go out of the country to get the new visa stamped.

I am trying to find if any one had the experience or has known about someone filing and H1B with a BSc in Health Sciences in Health Care with Respiratory Therapy option.
I know it is not possible to get an H1B on Respiratory therapy therefore I am looking for options as a healthcare administrator, health care analyst, health informatics, etc.
I have done alot of courses in computers like: MS applications, Oracle, Unix, Windows Adminstration, etc and I am close to get an associates in CS too.
Question:
- Are there any healthcare fields that require Bachelors degree to get H1 in my case?
- Can I work in IT and get H1 if the job description says Bachelors in any field?

I’m confused about using the EAD. Someone please clarify me….
I already received the EAD for me and my wife. Currently, I’m in the H1b which is expiring on Sep 2008 (6 years are over). My questions are?
•Can I be in H1b and still work another job as a part-time?
------ if the part time job is using a part time H1 only then you will be H1 and dependents in H4 using EAD meaning you lose H1/4
•If my wife wants to work using her EAD does it have any effect on her h4 status?
--- her status becomes AOS pending and H4 is gone
•If my wife loose her job during the use of her EAD what will be her status?
--- she will reamain AOS pending same as while using EAD
•I applied my I485 in July 2, 2007. As I already received my EAD, can I be unemployed after 180 days and start a business by myself?

•I know after receiving the AP I visit any their country. What will be my status after I come back? Still H1b or anything else?

HI guys,
Can anyone guide me about the process of getting extension while I-140 is pending in appeal with AAO.
I filed the appeal in January and got the receipt that I-140 is send to AAO. As we know that now it will take about 9-11 months for the final decision. My H1b 7 th year is expiring in June 2008. Does any have had the similar experience of filing extension while pending appeal. Also, how early should I file for the extension.
Please advise.

You can claim UI... I used the benefit earlier and the UI office was very helpful. It is insurance and a public burden. It would not be held against you in AOS adjustment. But again, I am not a lawyer so my opinion is strictly mine and should not be considered as legal opinion.....

I was born in Bangladesh and during my childhood I moved to India. In all my documents like school leaving certificate and Indian passport, the birth place is mentioned as India. I do not have any birth certificate either from Bangladesh or India and my plan is to use affidavit and non-availability certificate in lieu of birth certificate issued from municipality or other authorized body. In my entire US visa processing documents and petitions like H1B, I-140 etc. my birth places is mentioned as India. Can I still claim Bangladesh as the chargeable country for the purpose of visa allocation during the I-485 stage? If I claim Bangladesh to be my country of birth, will this be viewed as if I have provided wrong information in my earlier petitions? What could be other consequences?

So, wait for july 2nd.
Better than that, if you have buddies in FedEx, go bug them to accompany you to the nearest FedEx shoppe/store/offcie and do the shipment on July 1st.
It is my earnest advice and so is of many more here that filing on july 30th or earlier is risky and may end up with a rejection.

uscis sent incorrect alien registration # with my name to fbi for name check which ended up in an error . now after waiting for 2 years and 4 months uscis tells me that they are going to assign me a new alien # and send name check all over again. i am stuck please help..what options do i have to expedite this as it was uscis error.
